Assia Lucki, established in Brussels, Belgium, with the Chamber of Commerce number 0793244620, is referred to in these general terms and conditions as Assia Lückerath.
The other party will be referred to as the client in these general terms and conditions.
Agreement means the contract of assignment pursuant to which Assia Lückerath performs work for the client in exchange for payment of fees and costs and whereby these general terms and conditions have been declared applicable.
Article 2: Applicability of General Terms and Conditions
These terms and conditions apply to all quotations, activities, agreements, and delivery of services and products by or on behalf of Assia Lückerath, unless expressly deviated from in writing.
The terms and conditions also apply to the actions of third parties engaged by Assia Lückerath in the context of the assignment.
The latest version of these general terms and conditions always applies.
Article 3: Rates and Payments
The agreement is entered into for a definite period, unless the nature of the agreement dictates otherwise or if the parties expressly agree otherwise in writing.
The rates agreed upon at the conclusion of the agreement are based on the price level applicable at that time. If, because of unexpected circumstances, special requests, or inflation, the price changes, the client will be informed before both parties settle the agreement.
Invoices must be paid within 30 calendar days following the invoice date, unless otherwise agreed in writing or stated on the invoice.
If the client remains in default of timely payment of an invoice, he is legally in default and owing statutory interest from the moment of default until full payment.
Rush orders requested within 72 hours before the required delivery or event date are subject to a 100% rush fee.
For wedding invitations or wedding-related calligraphy/engraving assignments, 50% of the full fee must be paid prior to commencement of work. Work will only start after this payment is received.
If the client is late with payment and Assia Lückerath engages legal assistance, all additional collection costs, including lawyer fees, are borne entirely by the client, in addition to statutory late-payment interest.
Any errors in calligraphy or engraving caused by incorrect, incomplete, or unclear information provided by the client will be fully charged. Assia Lückerath uses the client’s lists as the sole reference.
Any gifts or gratuities provided by the client to Assia Lückerath, whether in cash, products, or services, fall outside the agreed payment for services and may be invoiced at Assia Lückerath’s discretion.
Article 4: Client Information
The client shall make all information relevant to the execution of the assignment available to Assia Lückerath.
The client guarantees the accuracy, completeness, and reliability of the information provided, even if it originates from third parties. Assia Lückerath will keep the data confidential.
The client indemnifies Assia Lückerath against any damage resulting from failure to comply with this article.
If the client fails to provide required information on time and execution of the order is delayed, any resulting extra costs shall be borne by the client.
Article 5: Execution of the Agreement
Assia Lückerath executes the assignment to the best of her knowledge and ability. She is not liable for failing to achieve the result intended by the client.
The client is responsible for providing a suitable workspace or workstation for Assia Lückerath during on-site activations or events. Inadequate or unsafe workstations may result in refusal of execution without affecting the client’s payment obligation.
Article 6: Modification and Cancellation
In case of unforeseen circumstances, Assia Lückerath may interrupt, move, or cancel an agreement. This includes illness, issues with materials, services, or locations necessary for proper execution. Notification must occur at least two days prior to the service. Parties will jointly attempt to reschedule or find an equivalent replacement.
If an event extends beyond the planned end time and no safe or reasonably available transport exists for return travel, the client agrees that an overnight stay will be charged. This cost forms part of the travel fee.
Article 7: Liability
Assia Lückerath is not liable for damages resulting from this agreement, unless caused intentionally or through gross negligence.
She is not liable for any loss or damage resulting from reliance on incorrect or incomplete information provided by the client.
She is not liable for loss, theft, or damage to the client’s personal property during on-site services.
The client is responsible for checking the quality of supplied content and products.
Assia Lückerath is not liable for color deviations on non-calibrated monitors or prints supplied by third parties.
She is not responsible for actions or omissions of third parties or software operation, even if recommended.
The client remains solely responsible for applying or performing knowledge or actions acquired during an agreement.
Assia Lückerath is not liable for errors in supplied texts or incorrect use of copyrighted images if the client approved the concept or failed to review it.
She is not responsible for researching third-party rights. The client confirms all documents delivered are their property and excludes liability.
In case of compensation owed, the maximum amount is the fee charged to the client.
If the client engages in discriminatory behavior, harassment, promotion of alcohol/tobacco, child labor, slavery, racism, sexism, or other unethical conduct, Assia Lückerath may immediately terminate the agreement. The full invoice remains payable.
Article 8: Intellectual Property
The client is granted publication rights only after full payment and may only use materials for agreed purposes.
The client may not edit, sell, or redistribute delivered material.
Any action violating this article constitutes copyright infringement.
By entering into the agreement, the client gives Assia Lückerath permission to use (image) material and results for portfolio, website, advertisements, social media, magazine articles, printed matter, trade fair material, and demonstration material, unless explicitly objected to. Sensitive information and privacy rights are respected.
Clients photographing workshops or training require permission from all attendees; content may only be moderately distributed with proper naming.
All photographs of Assia Lückerath’s engraving or calligraphy work remain her intellectual property and may be used for portfolio, website, advertisements, or promotional purposes.
One free test sample per client is provided. Additional tests are charged. If the client wants the test returned, all shipping costs are borne by the client.
Article 9: Special Provisions
Both parties must maintain the confidentiality of all information obtained in connection with the agreement. The client is referred to the privacy statement.
Assia Lückerath does not tolerate discrimination, racism, sexism, harassment, slavery, child labor endorsement, or unethical or illegal activity. Breach grants her the right to cease services immediately, and the invoice remains fully payable.
Assia Lückerath can conduct events and client interactions in multiple languages, which is considered part of the service offering.
Article 10: Delivery
The shipping address shall be as provided by the client. Assia Lückerath is not liable for errors in delivery information.
Shipping via letterbox post or package is at the client’s risk. Assia Lückerath recommends insured parcel post. Only when insured parcel post is used is Assia Lückerath liable for proper delivery.
Travel fees: €0.75 per kilometre (round-trip) plus parking. Travel time is charged at €50/hour, regardless of transport mode.
